You find a place. It is ₵2,500 a month, which seems manageable. Then the agent explains that the landlord wants two years up front, in cash, before you see a key.
This is the defining feature of the Accra rental market, and it catches everybody — returnees, newcomers and Ghanaians moving between cities alike.
What the law says
The Rent Act 1963 (Act 220) is clear. Section 25(5) makes it an offence for a landlord to demand or receive more than 6 months of rent in advance on a monthly tenancy.
That is the law. It has been the law since 1963.
On a ₵2,500 room, the legal maximum is ₵15,000. A typical demand of 12 months is ₵30,000 — about 25 times the median monthly salary in Ghana, handed over at once, before you have bought a mattress.

What actually happens
Almost every landlord in Accra ignores section 25(5), and almost every tenant pays anyway, because the alternative is not a cheaper house. The alternative is no house.
The law is unenforced for reasons that are worth understanding rather than being angry about:
- Housing is scarce. Demand in Accra far exceeds supply, so landlords set the terms. A tenant who objects is replaced by one of the four people behind them.
- Landlords are financing with it. Many treat the advance as construction capital — they are still building the upper floors with your rent. This is why “the house will be finished by the time you move in” so often turns out to be optimistic.
- The Rent Control Department is under-resourced. It exists, it accepts complaints, and it can mediate. It cannot police thousands of private tenancies.
- Nobody wants to be the test case. Enforcing your rights against a landlord who is holding two years of your money and controls your front door is a genuinely uncomfortable position.
Knowing the law is still worth something
You may well pay the advance anyway. But knowing that the demand is unlawful changes the conversation. It is grounds for a complaint to the Rent Control Department, it is leverage when negotiating the term, and it matters a great deal if the relationship later goes wrong.
How to reduce the damage
You will rarely negotiate the advance away. You can often improve the terms around it.
Negotiate the length, not the principle
“Two years” is an opening position more often than people assume. One year is frequently accepted, particularly if you can pay immediately and without conditions. Cash certainty is worth real money to a landlord who is building.
Get the term matched to the advance
If you pay two years, the tenancy agreement must say two years. This sounds obvious. It is the single most common way tenants lose money: paying 24 months of rent against an agreement that describes a 12-month tenancy, and then being asked to renew.
Get a receipt that describes what it is
Not “received ₵30,000”. You want the amount, the period it covers, the exact start and end dates, and the property address.
Verify the landlord owns the building
Before any money moves. Paying a large advance to someone who is not the landlord is the most common serious housing fraud in Accra.
Register the tenancy
A tenancy agreement should be lodged with the Rent Control Department within 30 days. Most are not. Registering yours costs little and creates an independent record of what you paid and for how long — which is exactly what you will wish you had if there is a dispute.

If the property has no water storage, add a polytank to the list immediately rather than discovering the need during your first rationing week.
When your advance runs out
Set a reminder three months before the end of the period you paid for. Landlords in Accra routinely raise the rent at renewal, and a tenant who discovers this two weeks before the money runs out has no room to negotiate and nowhere to go.
The Rent Act contains provisions on rent increases and on notice, but as with section 25(5), the practical protection they offer depends on your willingness to use the Rent Control Department. Knowing the end date and starting the conversation early is worth more than any statute.
